“This is a bad decision for the employees of Kaiser’s Tengelmann as well as for all consumers, small and medium-sized suppliers, farmers, and fair, healthy competition in the entire German food retail sector.
In approving the takeover of Kaiser’s Tengelmann by Edeka, the German Minister of economic affairs ignored the anti-trust concerns expressed by the German Cartel Office. He also disregarded the serious concerns raised by the German Monopoly Commission. And German Minister Gabriel completely discounted all specific alternatives and better solutions for the future of the employees at Kaiser’s Tengelmann and for fair competition in the German food retail sector.
We have repeatedly stated that we will use every legal means at our disposal to protect the interests of REWE Group in this merger process. For this reason, we will challenge the Minister's decision in the Higher Regional Court in Düsseldorf (Oberlandesgericht Düsseldorf).”
